General Terms and Conditions (T&Cs) – B2C (UAE / GCC)

1. Scope and Definitions
1.1 These T&Cs govern the relationship between POLYTALENT HR CONSULTANCY LLC, Dubai Branch Building -1-141, Office No. 1-141-434, Mankhool, Dubai – United Arab Emirates (“Provider”, “PolyTALENT”, “we”) and natural persons using our website, apps and services at polytalent.ae (“User”, together the “Parties”).
1.2 Any terms and conditions of the User are rejected unless PolyTALENT expressly agrees in writing.
1.3 These T&Cs apply to consumers (B2C) only. Use is permitted only to persons aged 18+ with legal capacity.
1.4 The T&Cs apply from the first use of our services—irrespective of whether a fee is charged.
1.5 For readability, the masculine form includes all genders.
2. Services
2.1 PolyTALENT operates a digital platform on which employers post vacancies and candidates submit applications/contact forms. PolyTALENT is not an employer and does not make hiring decisions.
2.2 Candidate use is currently free of charge. PolyTALENT may introduce paid add-ons in the future (see Sec. 5).
2.3 PolyTALENT may engage third-party providers (e.g., hosting, analytics, communication, recruitment partners) to deliver the services.
3. Account, Conclusion of Contract, Changes, Termination
3.1 By registering or using the services, the User accepts these T&Cs and our Privacy Policy (polytalent.ae/data-protection/).
3.2 PolyTALENT may modify features, free services and these T&Cs at any time. We will provide reasonable notice of material changes; continued use constitutes acceptance.
3.3 Service descriptions are invitations to treat, not offers. By submitting a form/registration the User submits an offer. We may accept expressly (e.g., confirmation) or implicitly by activating the account.
3.4 PolyTALENT may suspend or permanently deactivate accounts at any time, in particular for AGB/legal breaches, security risks, or prolonged inactivity (e.g., 24 months without login).
3.5 The User may delete the account at any time. Statutory retention obligations remain unaffected.
4. User Obligations
4.1 Provide accurate and up-to-date information (especially contact and qualification data).
4.2 Keep credentials confidential and notify PolyTALENT immediately of suspected misuse. The User is liable for misuse within their control.
4.3 Prohibited conduct includes: unlawful content, IP/right violations, tampering with security measures, scraping, spam, multiple/false profiles, and misrepresenting qualifications.
4.4 The User shall indemnify PolyTALENT from third-party claims (including reasonable legal fees) arising from the User’s culpable breach of these T&Cs or applicable law.
5. Fees
5.1 Basic candidate use is free.
5.2 If paid add-on services are offered, the then-current prices and service descriptions apply. Taxes/charges may be added. Unless stated otherwise, fees are due in advance.
6. No Guarantee of Success / Third-Party Information
6.1 PolyTALENT does not guarantee any particular outcome (e.g., interviews, salary, offers, time to hire). Hiring decisions are solely made by employers.
6.2 Job and employer information may partly originate from third parties; PolyTALENT assumes no warranty for such information.
7. Liability
7.1 To the fullest extent permitted by applicable law, PolyTALENT is liable only for damages caused by intent or gross negligence, and for death or personal injury.
7.2 For slight negligence we are liable only for breach of material contractual duties (duties essential to perform the contract), limited to the foreseeable, typical damage.
7.3 PolyTALENT is not liable for indirect or consequential loss, loss of profits, data loss, business interruption, delays, or third-party services outside our reasonable control.
7.4 Unless mandatory law provides otherwise, the aggregate liability of PolyTALENT is limited to the amount the User paid to PolyTALENT in the preceding 12 months, or AED 1,000, whichever is lower. For free use, liability—subject to Sec. 7.1—is excluded.
8. Data Protection & Communications
8.1 Personal data is processed in accordance with our Privacy Policy and applicable UAE law (including the PDPL).
8.2 The User consents to being contacted for service and recruitment purposes via email, phone, SMS/WhatsApp or in-app messages. The User may opt out at any time.
9. Cancellation, Termination & Refunds
9.1 The User may cease use at any time (account deletion).
9.2 For paid services, the cancellation/refund terms displayed at purchase apply. To the extent required by applicable UAE consumer protection law, pro-rated refunds will be provided; otherwise, fees are non-refundable once service delivery has started or access has been granted.
9.3 No refunds apply to free use.
10. User Content & Licence
10.1 The User retains rights to content provided (e.g., CV, documents).
10.2 The User grants PolyTALENT a worldwide, non-exclusive, royalty-free, transferable licence to store, reproduce, format, transmit and make available such content to employers for recruitment purposes, platform operation and legal record-keeping.
10.3 The User warrants having all necessary rights to grant the above licence.
11. Platform IP
11.1 Software, designs, databases, trademarks and content of PolyTALENT are protected.
11.2 Any reproduction, publication, distribution or commercial use without prior written consent is prohibited.
11.3 PolyTALENT may release updates/upgrades at any time without notice.
12. Third-Party Services & Links
12.1 Our services may link to or integrate third-party services. PolyTALENT is not responsible for their content, availability or privacy practices. Use is at the User’s own risk.
13. Force Majeure
13.1 PolyTALENT is not liable for failures or delays caused by events beyond our reasonable control (including network, power, hosting outages, war, governmental acts, labour disputes, natural events).
14. Assignment & Transfer
14.1 PolyTALENT may assign/transfer rights or obligations under these T&Cs to affiliates or successors.
14.2 The User may assign rights/obligations only with PolyTALENT’s prior written consent.
15. Electronic Communications & Signatures
15.1 The User agrees to electronic communications, records and signatures. These are legally binding to the extent permitted by law.
16. Governing Law & Jurisdiction
16.1 These T&Cs are governed by the laws of the United Arab Emirates.
16.2 Exclusive venue shall be the competent courts of the Emirate of Dubai, UAE. Mandatory consumer protections remain unaffected.
17. Final Provisions
17.1 These T&Cs constitute the entire agreement regarding the subject matter and supersede prior terms.
17.2 If any provision is invalid, the remainder remains effective; a valid provision closest to the economic intent shall replace it.
17.3 Side agreements/amendments require written form.
17.4 In case of translation, the English version prevails to the extent permitted by law.
